Digitaura Acceptable Use Policy (AUP)

This Acceptable Use Policy (“AUP”) defines the rules and prohibited conduct governing your access to and use of the Digitaura software platform, mobile applications, APIs, license validation servers, and associated services (collectively, the “Platform”), operated by Digitaura, Inc. (“Company,” “we,” “us,” or “our”).

By installing, accessing, or using the Platform, you agree to strictly adhere to this AUP. Violation of this AUP constitutes a material breach of our Terms of Service and may result in immediate suspension or termination of your license, without refund.

1. Prohibited Technical & Security Activities

You agree not to engage in any activity that compromises the integrity, security, or intellectual property of the Platform. Specifically, you shall not:

  1. Reverse Engineering & Tampering: Decompile, disassemble, reverse engineer, patch, or alter any native Apple Silicon binary, compiled Rust shell, Swift code, Python FastMCP sidecar, or license validation control.
  2. License Key Abuse: Share, publish, leak, resell, license, or distribute valid license keys, activation codes, or enterprise tokens to unauthorized third parties or beyond your purchased seat limit.
  3. Cracking & DRM Circumvention: Develop, use, or distribute cracks, keygens, memory injectors, or bypass scripts intended to circumvent local security isolation, POSIX 0600 permission checks, or subscription validation mechanisms.
  4. License Server Exploitation: Launch automated denial-of-service (DoS) attacks, rate-limit flooding, or unauthorized request spoofing against Digitaura license verification endpoints or API gateways.
  5. Malicious Code Injection: Use the Platform to generate, store, distribute, or execute malware, spyware, ransomware, prompt injection payloads, or malicious scripts.

2. Prohibited Commercial & Operational Activities

You agree to use the Platform strictly for lawful business and personal productivity purposes. You shall not use the Platform to:

  1. Fraudulent Financial Activity: Generate, release, or transmit falsified receipts, deceptive invoices, fraudulent tax records, or misleading financial statements.
  2. Illegal Field Operations: Dispatch work orders, track worker clock-ins, or manage field operations for illegal enterprises or unlawful labor practices.
  3. Anti-Money Laundering (AML) Violations: Utilize local journal entry tools or automated accounting sync capabilities to conceal, obscure, or wash illicitly obtained funds.
  4. Unauthorized Record-Keeping: Collect, store, or process personal data, healthcare records, or financial information of third parties without proper legal consent or in violation of applicable data protection laws.
  5. Impersonation & Deception: Use automated voice note parsing or AI drafting tools to generate deceptive communications that impersonate legal counsel, regulatory authorities, or law enforcement officers.

3. Compliance with Local & International Laws

You are solely responsible for ensuring that your use of Digitaura complies with all applicable local, state, federal, and international laws, regulations, and statutes, including but not limited to:

  • Export control and economic sanctions laws administered by the U.S. Department of the Treasury’s Office of Foreign Assets Control (OFAC) and the U.S. Department of Commerce.
  • Federal and state labor laws governing worker time-tracking, meal/rest breaks, and wage statements.
  • Financial record retention and tax reporting standards (e.g., IRS regulations, GAAP, IFRS).

4. Reporting Misuse & Security Vulnerabilities

4.1 Reporting Abuse

If you become aware of any violation of this AUP or unauthorized distribution of Digitaura software or license keys, please report it immediately to compliance@digitaura.ai.

4.2 Responsible Disclosure

Digitaura, Inc. values security research. If you discover a potential security vulnerability in our Platform or local LAN pairing protocol, please disclose it responsibly to security@digitaura.ai before making public disclosure.

5. Monitoring & Enforcement

5.1 Enforcement Rights

Digitaura, Inc. reserves the right, in its sole discretion, to investigate suspected violations of this AUP and take any of the following actions without prior notice:

  • Revoke or suspend active license keys and user account access.
  • Refuse technical support or software updates.
  • Terminate enterprise or individual subscription agreements.
  • Report illegal activities to appropriate law enforcement or regulatory authorities.

5.2 No Obligation to Monitor Local Vaults

Because Digitaura operates with a local-first zero-telemetry architecture, Digitaura, Inc. does not actively monitor or scan your local hardware directory (~/Vault/). Enforcement relies on account activity, license server interactions, and reported violations.
